These Terms and Conditions (“Terms“) constitute a legally binding agreement between you (“you,” “Client,” or “User“) and Pinnacle Trax, a brand operated by Sweetpea Works LLC (“Company,” “we,” “us,” or “our“), governing your access to and use of pinnacletrax.com, our managed hosting platforms, and all related services (collectively, the “Services“).

By accessing our website, submitting a form, booking a consultation, or subscribing to any Pinnacle Trax managed hosting tier, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Services immediately.

1. OUR SERVICES

Pinnacle Trax provides subscription-based marketing infrastructure — including website hosting, CRM setup, automated drip campaigns, social media management, content production, and AI video production — for independent life insurance agents, retirement planners, financial consultants, and select secondary markets. Specific deliverables vary by subscription tier (Plus, Premium, or Platinum) as described on our website.

The information provided through our Services is for general informational and business-marketing purposes only and does not constitute financial, legal, insurance, or investment advice. Clients remain solely responsible for the compliance of their own marketing content, communications, and business practices with applicable industry regulations (including but not limited to FINRA, state insurance regulations, and SEC requirements where applicable).

2. SUBSCRIPTION TIERS, BILLING, AND PAYMENT

Services are offered on a recurring monthly subscription basis. By subscribing, you authorize us to charge your designated payment method on a recurring basis until you cancel in accordance with our cancellation policy. You may upgrade or downgrade between Plus, Premium, and Platinum tiers as described on our website. Fees are non-refundable except where required by law or expressly stated otherwise in a signed client agreement.

3. INTELLECTUAL PROPERTY AND WEBSITE OWNERSHIP

All websites, templates, code, designs, and marketing systems built and hosted by Pinnacle Trax as part of a managed hosting subscription remain the proprietary property of Sweetpea Works LLC. Client websites built through our platform are not transferable and are not portable to outside hosting providers. Access to your website and associated marketing infrastructure is contingent upon maintaining an active subscription; upon cancellation or non-payment, access may be suspended or terminated in accordance with your service agreement.

All Pinnacle Trax branding, trademarks, logos, and site content (excluding client-specific business information and client-supplied materials) remain the property of Sweetpea Works LLC and may not be copied, reproduced, or used without written permission.

4. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (a) all registration and account information you submit is truthful and accurate; (b) you have the legal authority to enter into these Terms on behalf of yourself or the business you represent; (c) you will not use the Services for any unlawful or unauthorized purpose; and (d) your use of the Services will comply with all applicable laws and regulations, including those governing your profession or industry.

5. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make them available. Prohibited activities include, without limitation:

  • Uploading or transmitting viruses, malware, or any other malicious code
  • Attempting to bypass security measures or gain unauthorized access to our systems or other clients’ data
  • Using automated means (bots, scrapers) to access the Services without our express permission
  • Harassing, abusing, or harming another person through our Services
  • Impersonating another person or entity
  • Using the Services to violate any applicable law, regulation, or industry compliance requirement

6. NO SOLICITATION OF PINNACLE TRAX

Our website contact forms, consultation booking tools, and email addresses are provided exclusively for prospective and current clients seeking Pinnacle Trax’s own marketing infrastructure services.

These forms and contact channels are not to be used by other marketing agencies, vendors, freelancers, recruiters, or sales representatives to advertise, solicit, or promote their own products or services to Pinnacle Trax, Sweetpea Works LLC, or its principals.

Any unsolicited commercial submissions, cold outreach, or solicitations submitted through our forms, email, or any other contact channel:

  • Do not create any business relationship, obligation, or right to a response;
  • May be discarded without review or reply;
  • Do not grant the sender any right to add Pinnacle Trax or its representatives to any mailing list, CRM, or outreach sequence; and
  • May, if persistent or abusive, result in the sender being blocked from further contact.

We reserve the right to take appropriate action, including reporting to relevant platforms or authorities, against parties who use automated tools or scraping methods to harvest contact information from our site for solicitation purposes.

7. SUBMISSIONS

Any feedback, suggestions, ideas, or other information you provide to us regarding the Services (“Submissions”) shall be considered non-confidential, and we shall be free to use such Submissions on an unrestricted basis without compensation to you.

8. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to third-party websites or content that we do not own or control. We are not responsible for the content, accuracy, or practices of any third-party sites, and inclusion of any link does not imply endorsement.

9. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE SERVICES, AND DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE ANY SPECIFIC MARKETING RESULTS, LEAD VOLUME, OR REVENUE OUTCOME FROM USE OF THE SERVICES.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SWEETPEA WORKS LLC, PINNACLE TRAX, OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

11. TERM AND TERMINATION

These Terms remain in effect while you use the Services. We reserve the right to suspend or terminate your access to the Services, without notice, for any violation of these Terms, including engaging in prohibited activities described in Sections 5 and 6. Clients may cancel their subscription in accordance with the cancellation terms in their service agreement; upon cancellation, access to hosted websites and associated tools will be discontinued as described in Section 3.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Jefferson Parish, Louisiana.

13. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time, and to update these Terms periodically. Continued use of the Services following any changes constitutes acceptance of the revised Terms. We do not guarantee the Services will be available at all times and are not liable for any interruption, delay, or discontinuation of the Services.
